Thomas Fortenberry

Thomas Fortenberry focuses his practice on intellectual property matters, including intellectual property litigation; patent portfolio analysis and development; patent preparation and prosecution; patent infringement and validity opinions; and copyright and trademark registration.  A registered patent lawyer, Mr. Fortenberry has extensive experience in serving clients in the technology industry.

Mr. Fortenberry's patent litigation experience includes:

Defending the world's largest telecommunications companies in litigation regarding smart phone technology (Eastern District of Texas)

Defending a major television maker in litigation over heat management devices (Eastern District of  Texas)

Defending a global automobile manufacturer in litigation regarding vehicle audio systems (Eastern  District of Texas)

Defending one of the largest medical device companies in the United States in litigation over  medical  devices used to repair spinal fractures (Western District of Tennessee)

Other patent counseling matters in which Mr. Fortenberry has been involved include-

Preparing and prosecuting more than 200 patent applications before the U.S. Patent and Trademark  Office in the areas of multimodal software applications, Web applications, massive parallel  computing, operating systems, middleware, database systems, pervasive computing systems, memory devices, memory management, computer bus structures, heat sinks, and power  management systems, as well as many other technologies

Developing and implementing comprehensive patent strategies for multimodal interactive Web  applications, including voice-enabled Web applications

Implementing comprehensive patent strategies for massively parallel supercomputers and financial  market data systems

Valuating the patent portfolio of a major financial software company during acquisition negotiations

Analyzing non-infringement and invalidity of a patent asserted against major financial software  company's core-technology

Preparing non-infringement and invalidity opinion for a large telecommunications company of a  patent concerning location-based services
Prior to attending law school, Mr. Fortenberry served as chief operations officer for a creative design  company.

Mr. Fortenberry received his B.A. with honors in engineering route to business with a focus on electrical engineering and business management and a concentration in mathematics in 2001 from The University of Texas at Austin.  He received his J.D. with honors in 2005 from The University of Texas School of Law.

He is a member of the State Bar of Texas and is licensed to practice before the U.S. Patent and Trademark Office.  Mr. Fortenberry is admitted to the U.S. District Courts for the Eastern and Western Districts of Texas.
